CHAPTER 51 — Utility Rates And Charges

§ 51.01 Security Deposit For Utility Services

   When an applicant makes his or her application for service, he or she shall make a cash deposit as follows.
   (A)   New service. For residential use by homeowners, for residential use by renters, for trailer houses or mobile homes on rented lots and for business uses, for the purpose of providing funds for the maintenance of the town’s water, sewer and trash departments, and for other purposes, the Board of Trustees shall establish rates, charges, deposits and fees for utility services by motion, resolution or ordinance.
   (B)   Moving or additional accounts.
      (1)   It is not required that a new security deposit be posted in the event that an applicant moves within the service area of the town.
      (2)   If the applicant for water, sewer or trash service owns a home or business inside or outside of the town limits for which a deposit is currently being held by the town and the applicant acquires another home or business inside the town limits, then the applicant need not pay an additional deposit.
      (3)   If the applicant is building for rental purposes, then the respective renter or renters shall make a deposit at the time the renter or renters make an application for service.

§ 51.02 Customer Service Fee For New Water Service

   (A)   When an applicant makes their application for service, in addition to the security deposit, the applicant shall pay a customer service fee that the Board of Trustees shall establish. This fee shall be established by motion, resolution or ordinance. The fee shall be for inside and outside of the town limits for water service hookups or connections.
   (B)   This fee shall not be refunded. In the event that an applicant moves within the service area of the town, another customer service fee shall be required, which fee shall not be refunded.

§ 51.03 Water Service Charges; Water Tap Fees

   For the purpose of providing funds for the maintenance of the water service of the town, water tap fees and for other purposes, the Board of Trustees shall establish rates, charges, deposits and fees for utility services by ordinance, motion or resolution. A schedule of charges for the use of water service to be levied and collected for the use of water inside and outside of the corporate or town limits each month. A copy of the current rates and charges shall be available in the office of the Town Clerk-Treasurer.

§ 51.04 Sewer Hookup Requirement; Fees

   (A)   When a public sewer becomes available at the property line of a person living within the boundaries of the town, the building located on the property shall be connected to the sewer within 30 days and the septic tank formerly used shall be disconnected and its use terminated.
   (B)   The owner shall make the connection and pay the fees set by the Board of Trustees. All rates, charges, deposits or fees shall be established by ordinance, resolution or motion, as the case may be. A copy of these fees shall be available in the Town Clerk-Treasurer’s office.

§ 51.05 Minimum User Charge

   (A)   For the purpose of providing funds for the maintenance of the sewer or wastewater treatment systems of the town, and for other purposes, the Board of Trustees shall establish rates, charges, deposits and fees for utility services by ordinance, motion or resolution, as the case may be. A copy of the current rates and charges shall be available in the office of the Town Clerk-Treasurer.
   (B)   In cases of users of metered water consumption using water from another water source, such as a rural water district, the metered water consumption will be determined by using the records of metered water consumption from the other water source.
   (C)   In cases of users not on a metered basis, the Utility Superintendent shall establish an estimated water consumption based on a comparison of the nonmetered user with a metered user of a similar class; for example, a nonmetered family of four will be compared to a typical family of four with a water meter to establish water consumption.

§ 51.06 User Charge Schedule

   (A)   Formula. As the BOD, suspended solids and other pollutant concentrations discharged shall be approximately equal for all domestic users, users shall be charged on a volume basis in accordance with the following formula.
         Cu = Cb + Ct/Vt (Vu)
   (B)   Symbols and definitions.
      (1)   Cu = A user’s charge per unit of time;
      (2)   Cb = A user’s base minimum charge (for debt retirement, billing, administration and the like) per unit of time;
      (3)   Ct = Total operation and maintenance (O&M) costs per unit of time;
      (4)   Vt = Total volume contribution from all users per unit of time (may include extraneous flows); and
      (5)   Vu = Volume contribution from a user per unit of time.

§ 51.07 Excessive Strength Charges

   (A)   Formula. For any user, when the BOD exceeds 204 milligrams per liter (maximum limit for average domestic waste), the suspended solids exceed 240 milligrams per liter (maximum limit for average domestic waste), or when other pollutants in normal domestic sewage, a surcharge shall be added to the basic charge. This surcharge shall be calculated by the following formula.
         Cs = (Bc(B) + Sc(S) + Pc(P)Vu
   (B)   Symbols and definitions.
      (1)   Cs = A surcharge for wastewaters of excessive strength;
      (2)   Bc = Operation and maintenance (O&M) costs for treatment of a unit of biochemical oxygen demand (BOD);
      (3)   B = Concentration of BOD from a user above a base level;
      (4)   Sc = O&M costs for treatment of a unit of suspended solids (SS);
      (5)   S = Concentration of SS from a user above a base level;
      (6)   Pc = O&M costs for the treatment of a unit of any pollutant;
      (7)   P = Concentration of any pollutant from a user above a base level; and
      (8)   Vu = Volume contribution from a user per unit of time.

§ 51.08 Toxic Pollutants Charges

   Each user that discharges any toxic pollutants which cause an increase in the costs of managing the effluent of the sludge of the treatment works shall pay for such increased costs.

§ 51.09 Extraneous Flows Charges

   The costs of operation and maintenance for all flows not directly attributable to users, such as infiltration/inflow, shall be distributed among users on the same basis as operation and maintenance charges.

§ 51.10 Periodic Review And Revision

   (A)   The user charge ordinance shall be reviewed not less often than every two years regarding the wastewater contribution of users and user classes, the total costs of the operation and maintenance of the treatment works and its approved user charge system.
   (B)   The charges for users and user classes shall be revised to accomplish the following:
      (1)   Maintain the proportionate distribution of operation and maintenance costs among users and user classes;
      (2)   Generate sufficient revenue to pay the total operation and maintenance costs necessary to proper operation and maintenance, including replacements, for the treatment works; and
      (3)   Apply excess revenues collected from a class of users to the costs of operation and maintenance attributable to that class for the next year; rates shall be adjusted accordingly.

§ 51.11 Garbage Service Charge

   For the purpose of providing funds for the maintenance of the garbage service of the town, and for other purposes, the Board of Trustees shall establish rates, charges, deposits and fees for utility services by ordinance, motion or resolution, as the case may be. A copy of the current rates and charges shall be available in the office of the Town Clerk-Treasurer.
