§ 50.01 Lease Of Systems To Public Works Authority
(A) The town has leased the operation of its water and sewer systems to the Town Public Works Authority, including setting rates for use of the systems and all regulations governing them. For a copy of current rates and rules, see the minutes of the Town Public Works Authority.

§ 50.02 Applying For Utility Services
Every person, firm or corporation desiring to have his or her premises connected with any of the town’s utilities, water, sewer or trash collection shall make application and sign a contract therefor upon a printed form to be furnished for that purpose and shall pay the regular fees and deposits for installation of the service.

§ 50.03 Separate Service Connections Required
Every separate premises supplied must have its own separate service connection with the mains or lines, and the premises so supplied shall not be allowed to supply water or sewer to any other premises.

§ 50.04 Utility Fees And Billings Generally
(A) All fees and charges in connection with any customer’s use of the sanitary sewer system, the water facility system or the operation of the town’s collection and disposal of refuse and garbage are billed in accordance with the applicable rates set, as provided in § 50.05 of this chapter.
(B) All fees and charges owing for any of these utility services shall be billed on one monthly bill submitted to the customer each month.

§ 50.05 Rates And Charges Set By Board Of Trustees
The Board of Trustees shall establish rates, charges, deposits and fees for utility services by ordinance, motion or resolution, as the case may be. A copy of the current rates and charges shall be available in the Town Clerk-Treasurer’s office.

§ 50.06 Bill Payment; Undue Hardship Adjustments
(A) Bill issuance, payment responsibility. All bills for utility services shall be rendered monthly and as soon after the meter reading date as practicable. Reasonable care will be exercised for the delivery of utility bills. The failure to receive such bills shall not relieve the consumer from payment of the bills within the prescribed period, nor exempt him or her from the responsibility imposed for a delinquency of accounts.
(B) Full payment required. All charges for utility services shall be due and payable at the town offices at the time indicated on the bill therefor. All accounts which become delinquent shall be paid in full, and no partial payments will be accepted by the town.
(C) Adjustments to charges and bills. Authorized agents of the town are empowered from time to time to make adjustments in the charges for utility services and in the bills rendered to customers when an investigation by such persons reveals that the charges are excessive due to legitimate reasons or causes, such as when, in the judgment of the authorized agents, the full charge would work an undue and unfair hardship on the consumer, or for any other reason the agents deem appropriate.

§ 50.07 Delinquent Payments; Charges And Disconnections
(A) (1) Upon the failure of any customer to pay any part of a utility bill for any utility service by the due date on the bill, the following actions and penalties may result.
(a) A penalty of all amounts owing on a utility bill is added to any utility bill which is not paid by the due date of the bill.
(b) The authorized agents of the town may disconnect or discontinue any or all utility services to the customer after mailing or posting written notice to the customer of the intent of the town to disconnect or discontinue any or all of the utility services.
(c) The authorized agents of the town may discontinue to furnish water to any customer refusing or neglecting to pay all or any part of a utility bill submitted after providing written notice to the customer of the intent of the town to disconnect the water service.
(2) If any utility service is discontinued or disconnected pursuant to this section, then the town and its agents shall not reconnect nor reestablish the service until the full amount of any outstanding utility service bill is paid, plus the penalty provided in this section, plus any applicable charges or expenses in reconnecting or reestablishing the service.
(B) (1) If a town personnel goes to the premises to shut off the service and the occupant pays the town personnel prior to his or her shutting off the service, then there shall be added to the bill a sum for the trip made by the town personnel to shut off such service.
(2) All bills, penalties and fees collected as hereinabove specified shall be paid over to the Town Clerk-Treasurer. Nothing herein shall be construed as preventing the town from instituting suit for the recovery of any delinquent accounts.
(C) (1) The Town Clerk-Treasurer may not accept payment of a water bill without payment of the sewer service charge, nor shall the Clerk-Treasurer accept payment of a sewer bill without payment of the water bill.
(2) The failure to pay any utility bill in accordance with divisions (A) and (B) above shall be grounds for discontinuing any or all of the utility services furnished to the customer whose bill is delinquent.

§ 50.08 Right To Interrupt Service
The town reserves the right to shut off the supply of water without notice for repairs, extensions, nonpayment of rates or for any other reason, and no liability shall attach therefrom.

§ 50.09 Tampering With Meters Unlawful
Tampering with water meters or meter boxes of the town, or the placing of any bypass connection on or around the meters, or the use of any other device tending to interfere with the proper registration of the same, is unlawful.

§ 50.10 Damaging Equipment Unlawful
It is unlawful and an offense for any person to destroy or injure any water pipe, hydrant, faucet, pole or other sewer or water equipment erected or placed by or belonging to the town.

§ 50.99 Penalty
(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99(A) of this code of ordinances.
(B) Violations of the rates and rules of the Town Public Works Authority, adopted and incorporated by reference in § 50.01 of this chapter and fully applicable as if set out at length therein, are punishable as provided in § 10.99(A) of this code.
